See, this is what happens when people read too fast & then make assumptions.

No sir, as the quick bit of detective work done by the moderator shows, I am not US therefore not liable for income taxes, never earned a $ in the US & am very happy to be paying lots of taxes as we travel around.

do any of you use the Montana LLC option to buy or register your 5th wheel. I live in SC and it seems too good to be true

As you can see you got a lot of reponses but none from SC. Now if you are planning on setting up a Montana LLC, SC requires you to be out of the state 180 days a year. Not a problem if you are retired and use your motorhome a lot. The big savings is with property tax since we have a sales tax cap of $300 regardless of purchase price. It is your responsibility to maintain records proving that you have complied to the 180 day requirement. Gas and campground receipts are great documentation. Some of us spend 4 or 5 months in Florida during the winter. One neighbor spends 5 months in Las Vegas plus the addtional time out of state during the year to get his 180 days. Call the Bennett Law Firm in Montana and they will send you the SC requirements for an LLC. I am sure you have seen a lot of Montana plates as well as other out of state plates on motorhomes in SC. Several of my neigbors have Montana license plates on their motorhomes and a few have Florida plates. When you are looking at a yearly $4000 or more property tax bill on your motorhome, people do start looking at tax avoidance which is not tax evasion. The same criteria applies to large boats, we had an instance in our local paper where a very wealthy lawyer did not move his yacht out of SC waters within the 180 days and the tax assessor got him for over $100,000 in property tax. There were no additonal fines just propery tax due for the year. The local marina's are trying to get the law changed (fat chance) claiming that the states excessive property tax reduces their income and is not inviting to boaters that have the potential to spend a lot of money in SC.

Please explain to me how you can spend 160 days a year out of your State without spending (elsewhere) far more than the $4,000 you've taken such pains to evade paying in taxes due to your home state.

IMHO if the purpose and intent of the LLC is tax avoidance it is tax evasion, just not in Montana (already a welfare state) which is profiting at the expense of the resident state…

"just not in Montana (already a welfare state)"

Isn't it amazing how offensive some people can be without even trying.
It makes me glad my Mother took me OUT of Blair County, Pennsylvania in 1948, and I have been a Montanan ever since!

It is easy to be out of state 180 days a year when you spend 4 months snowbirding in Florida and 2-3 months during the summer 2-3 weeks at a time traveling to other locations like the Smokey Mountains ect. The yearly travel is our normal travels during the year, we also have friends in Kansas that we visit every couple of years so the travel time adds up. This is our normal yearly travel schedule and the costs are always the same, our property tax of $4000.00 a year would be additional to our yearly travel costs. I have a neighbor that bought a lot in Las Vegas and spends 6-7 months during the fall and winter in Las Vegas, he also has his motorhome registered in a Montana LLC.

There was nothing meant to be offensive about it, Montana ranks high year after year taking more federal dollars than they give making it a welfare state… something I am sure you are already aware of…

Its simple donor states like California support welfare states and usually the donor states have higher state and local taxes at the same time…

I just happen to think it is appalling for Montana to profit from allowing the setting up of fake businesses to aid and abet tax evasion in other states…

If the truth is offensive then I maybe it should be…
